User Agreement
"BP Doctor" and related technologies and functions (hereinafter collectively referred to as "the Service") are operated by YHE Intelligent Technology (Hangzhou) Co., Ltd. (hereinafter referred to as "YHE"). "You" and "User" in this Agreement refer to any individual who uses and/or accesses the Service.
This User Agreement and other terms of service, rules or reminders issued by YHE for this service (hereinafter collectively referred to as "this Agreement") are the terms on which we provide you with this service for use and access. Through this agreement, you will understand how YHE and YHE provide you with this service, the activities permitted and prohibited in this service, measures to deal with problems and other important information. Please read this agreement carefully, especially the important contents such as clauses concerning the exclusion or limitation of liability, applicable laws and
dispute resolution clauses. When you agree to this agreement or use this service as prompted on the page, it is deemed that you have reached a legally binding contract with YHE, and YHE will perform the corresponding contractual obligations in accordance with this agreement. If you do not agree to this agreement, please do not use this service.

You expressly represent and warrant that you have sufficient legal rights or authority to sign and perform this Agreement; your signing and performance of this Agreement will not conflict with or cause a breach of any other agreement or arrangement that you are required to perform.
If you are a minor (under the age of 18), before you decide whether to use the service, please read this agreement with your parents or other guardians to ensure that they clearly understand the content of this agreement . Do not use this service before. At the same time, we recommend that parents or other guardians exercise reasonable supervision and guidance on your children's use of the Internet, mobile phones and other devices.
The use of this service requires that you have one or more terminal devices compatible with this service and complete a wireless mobile data service
network connection.
YHE grants you a limited, non-exclusive, non-transferable, non-sublicensable, but revocable license to access and use the Service in accordance with this Agreement.
You need to have a YHE account to access or use this service. When you have a YHE account, we will collect and use your email address according to the registration method you choose; as well as the avatar, nickname, gender, time zone, language and regional data you upload; when you use your mobile phone number to register a YHE account, According to the legal requirements of the People's Republic of China, we will collect your registered mobile phone number for real-name authentication.
This service is an Internet application that YHE provides consumers with sports and health services.
This service includes the following services.
1. Account login: In order to manage your sports health data, you need to register and log in to your YHE account.
2. Wearable and sports health equipment management: This service supports
the management of your YHE equipment. Connect the device through Bluetooth pairing, manage the use, configuration and upgrade of the device, and obtain your sports health data from the device, and display it after comprehensive processing through the "BP Doctor" application.
3. Personal data management: This service can edit your nickname, avatar, gender, age, height, weight and personal settings related information.
4. Sports health data management: When you use BP Doctor to synchronize the data of related equipment, we will record the information collected and calculated by the equipment, including steps, heart rate, PPG data, distance during exercise, pace, speed, cadence, stride width. When you open BP Doctor after exercising, the sports health information recorded by the device will be automatically synchronized to BP Doctor.
5. User experience improvement service: In order to improve product quality and user experience, you are required to share the usage data of using the BP Doctor app and paired connected devices, including the pages you open in the app and the buttons you click, and the operation of functions in the app and device , which is used to analyze and count the usage of devices and applications, and improve the user experience.
6. "My Relatives and Friends" service: The "My Relatives and Friends" function supports convenient and intuitive sharing of exercise records (steps) and health data (blood pressure, heart rate, blood oxygen, sleep) among family
members, relatives and friends. Relatives and friends who are not authorized by you to follow will not see your sports health data, and you can terminate the data sharing by "cancel authorization".
7. Feedback: If you encounter problems during use, you can upload feedback information for feedback through "Feedback".
You should properly keep your YHE account username and password (hereinafter referred to as "account information"), and must not share such information with anyone. We recommend that you choose a strong password and keep it safe. It is your responsibility to keep your password secure. If you provide details of your account information to a third party, you shall be solely responsible for any losses and liabilities arising therefrom.
If you think someone may be using your account information, you should notify us immediately using the contact information in the "Contact Us" section. You may not use other people's YHE account to use or access this service, and any disputes arising therefrom will be borne by you. You should take appropriate measures to protect your account information and avoid unauthorized use of your aforementioned information by third parties.
You undertake and agree to access and use the Service in a lawful and ethical
manner in accordance with this Agreement.
You shall not use this service to transmit any content of the following nature, or otherwise participate in or conduct any activity of the following nature:
(a) upload, download, store, reproduce, post, transmit, email or otherwise make available content prohibited by law, regulation and policy as follows:
i. Opposes the fundamental principles established by the Constitution;
ii. Endangering national security, divulging state secrets, subverting state power, and undermining national unity;
iii. Damage to national honor and interests;
iv. Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
v. Those who undermine the state's religious policy and promote cults and feudal superstitions;
vi. Spreading rumors, disrupting social order, and undermining social stability;
vii. Spreading obscenity, pornography, gambling, violence, murder, terror or instigating crime;
viii. Insulting or slandering others, infringing upon the legitimate rights and interests of others;
ix. Endangering social morality or the fine cultural traditions of the nation;
x. Infringing the patent rights, copyrights, trademark rights, reputation rights or any other legitimate rights and interests of any other third party;
xi. Information containing other content prohibited by laws and administrative regulations.
(b) Infringe on the privacy rights, trade secrets, trademark rights, copyrights, patent rights and other legal rights of others;
(c) engage in any illegal dealings, such as the sale of firearms, drugs, illicit drugs or other prohibited substances;
(d) Plan to carry out or carry out illegal activities such as money laundering and cash-out;
(e) remove any copyright, trademark or other proprietary notices contained in the Service;
(f) copy or alter the Service, in whole or in part, or permit the Service or any part thereof to be merged with or incorporated into any other Program;
(g) unauthorized access or attempted access to or damage to any part of the Service or related systems or networks;
(h) disassemble, decode or reverse engineer the Service or any part thereof, or create derivative works based on the Service or any part thereof, or attempt to engage in similar activities prohibited by applicable law;
(i) distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, broadcast, broadcast or otherwise use the Service;
(j) Submit or otherwise provide to any person in any form all or part of the content of the Service (including subject matter and source code) without the prior written permission of YHE;
(k) impersonate another person, falsely claim or otherwise misrepresent your affiliation with a person or entity;
(l) use the Service (or any part thereof) for any unlawful purpose, in any unlawful form, or in violation of this Agreement, or commit any fraudulent or other malicious act, including but not limited to hacking the Service (or links to the Service) URL) or any operating system or implant malicious code, including viruses or harmful data;
(m) access and/or use the Service infringes the intellectual property rights of YHE or any third party;
(n) collect information from users of the service, or use automated means to access the service or the YHE system, or attempt to decipher any content into or extract any content from the server running the service;
(o) Develop, support or use software, devices, scripts or any other means or processes (including crawler software, browser plug-ins or any other technical or human work) to capture or otherwise copy user information from the Service and other data;
(p) use the Service for commercial purposes without the prior written permission of YHE;
(q) use the Service to engage in any illegal commercial transaction, such as the sale of arms, drugs, illegal items, pirated software or other contraband;
(r) provide gambling information or use any means to induce others to gamble;
(s) ask for another person's login information or access another person's account;
(t) engage in money laundering, cash-out or pyramid schemes;
(u) breach this Agreement (or any part thereof), or facilitate or encourage such conduct;
(v) use the Service to damage, disable, impair or jeopardize or overload the Service, the YHE system or its security, interfere with the computer systems of other users or any other party, hack into or gain unauthorized access to the Service or YHE Content (as defined below) or data; or other acts that violate national laws, regulations, rules and policies, or other acts that violate this Agreement.
Except as otherwise provided by laws and regulations or as otherwise agreed by YHE and you, YHE and/or YHE's upstream licensors are not responsible for
all information obtained under or through the Service, including text, video and audio, pictures, icons, applications, designs , software, scripts, programs, copyrights, trademarks, trade names, logos and other materials and services, as well as the appearance and experience of the foregoing (collectively, "YHE Content"), all rights reserved. Except as otherwise provided in this Agreement, your access to and/or use of the Service does not constitute a transfer of any title to the Service or its content.
You may not alter, copy, extract, revise or add to the YHE Content in any way, nor may you sell, copy, transmit, license or misuse the YHE Content. If you need to republish, extract, copy, transmit or otherwise use any YHE content, you must contact YHE in advance and obtain YHE's prior written permission, except as expressly stated in this agreement. This does not affect any of your rights under applicable mandatory laws.
If you believe that the Service, or any portion thereof, infringes any copyright, trademark, patent, trade secret or other intellectual property right, or you have other concerns about the Service, please let us know through the contact information in the Contact Us section.
"User Content" refers to the information, content and materials formed by users through the use of the Service, such as graphics, text, images, sounds, videos, software and data files.
Content that you upload, download, post, email, transmit, or store by you or on your account. Because YHE does not control or have access to User Content, YHE cannot ensure the accuracy, completeness and appropriateness of any User Content. You agree that the risk arising from the use of user content of other users of this service is entirely at your own risk, and YHE shall not be liable for any user content that you deem vulgar, objectionable, indecent or inappropriate.
We take your personal information and privacy protection very seriously. You understand and agree that during your use of this service, for the purposes necessary to provide this service or based on your consent, we will process your personal information in accordance with the "Privacy Policy". To this end, you need to read the separate and express "Privacy Policy" carefully to understand the purpose and method of processing personal information, the types of personal information processed, the storage period, the methods and procedures for exercising users' rights, and what YHE does to protect your personal information. measures taken, etc.
This service is for your personal use only and may not be provided to any third party for use. You agree that YHE and YHE affiliates, principals, directors,
employees, contractors, agents, third-party payment service providers, partners, licensors and distributors (below Collectively, the "YHE Parties") disclaim any responsibility.
The use of this service may be interrupted, delayed or disrupted for an unknown period of time for reasons beyond our control. You agree that YHE shall not be liable for any claims arising out of or related to the foregoing interruptions, delays, disturbances or similar failures.
To the fullest extent permitted by applicable law, YHE shall not be liable for any damages caused by your or anyone else's inability to access or use the Service due to:
(a) YHE maintains or upgrades the system or hardware and software resulting in suspension or termination of this service;
(b) delays or failures in communications with systems or networks not owned or controlled by YHE;
(c) Suspension, cancellation or termination of contracts or other agreements between YHE and any third-party payment service provider;
(d) errors or interruptions due to hacking or similar security implications; or
(e) other reasons beyond YHE's reasonable control.
This service is provided "as is" and "as available" without warranty or endorsement of any kind. To the fullest extent permitted by applicable law,
the YHE Party does not acknowledge any express or implied warranty, condition or other agreement, nor does it make any guarantee, undertaking, representation or warranty with respect to:
(a) the completeness, accuracy, reliability or timeliness of any Content available under or through the Service;
(b) the Service or the server hosting the Service is free of defects, errors, viruses, bugs or other harmful elements;
(c) whether deficiencies in the operation or functionality of the Service will be corrected;
(d) warranties relating to specific features of the Service, or the reliability, quality or accuracy of any information you obtain while using or accessing the Service;
(e) whether the Service is secure and error-free;
(f) whether the Service is reliable, high-quality, accurate, available or capable of meeting your needs, producing or achieving particular results or outcomes. YHE shall not be liable for any loss or damage caused by reliance, use or interpretation of the Service, in whole or in part, or information obtained by you (or anyone else) accessing and/or using the Service.
The laws of some countries do not allow the exclusion or limitation of certain warranties, guarantees or liabilities in a contract. If these laws apply to you, all
or part of the foregoing exclusions or limitations may not apply. Nothing in this Agreement affects your statutory rights as a consumer.
To the fullest extent permitted by applicable law in your jurisdiction, you shall hold YHE Parties harmless from any claims, actions or prosecutions arising out of or in connection with:
(1) your content;
(2) Your use of the Service;
(3) your breach of any part of this Agreement or the applicable End User License Agreement;
(4) You infringe the intellectual property rights or any other rights of third parties;
(5) Anyone who uses your YHE account to perform similar acts or violate the above content.
Including any liabilities, damages, expenses, legal fees and attorney fees arising from various disputes, complaints and lawsuits arising from the above circumstances. You warrant and agree to promptly and fully assist in the defense of any YHE party reasonably requested.
You can terminate this agreement by canceling your account or by stopping using the service.
After your account is terminated, YHE can immediately and permanently delete any and all data, files and stored contents under your account, but based on certain legal and practical factors, YHE may not be able to delete the backup copies of these data. Also, content you send to other users, including messages, may not be deleted.
After your account is terminated, you will not be exempted from the obligation to pay any fees that should still be paid before (including) the termination date, and YHE and any third party will not be responsible for the consequences of not being able to obtain this service after your account is terminated. any liability.
We may suspend, restrict, cancel or terminate your access to all or part of the Service in accordance with applicable law without any liability to any person or third party. We will endeavour to notify you before taking such action. However, we may immediately suspend, restrict, cancel or terminate your access to all or part of the Service without prior notice to you under the following circumstances:
(a) you have violated or YHE has reason to believe that you are about to
violate this Agreement, including any conventions, policies or guidelines contained therein;
(b) you or anyone acting on your behalf engages in fraudulent or illegal activity, or provides false or misleading information to YHE;
(c) respond to requests from law enforcement or government agencies in accordance with valid legal process;
(d) To perform emergency system or hardware maintenance or update work;
(e) for unforeseen technical, security or business reasons.
The expiry or termination of this Agreement shall not affect the conditions expressly stated in this Agreement that are operable or shall survive its expiry or termination, nor shall it affect any accrued rights or obligations or any conditions which shall survive the expiry or termination of this Agreement rights or obligations.
Any terms of this Agreement that are expressly or by their nature ought to survive termination will remain in full force and effect after termination of this Agreement until the conditions of those terms are satisfied or by their nature should expire.
YHE is always updating, revising and improving this service. YHE may add or delete functions or performance of this service, set new restrictions or
temporarily suspend or permanently stop the provision of a service; YHE may also revise this agreement at any time based on the update of this service.
Once the updated terms of the agreement are published, it will replace the original terms of the agreement, and we will publish the changes to this agreement on the APP page in a timely manner. If you do not accept the revised agreement, please stop using this service immediately, and your continued access or use of this service is deemed to accept the revised agreement.
If amendments to this Agreement materially affect you or materially limit your access to or use of the Service, we will notify you within a reasonable time prior to the change. We may not be able to meet the aforementioned notice period requirements for changes to the Service to meet security, legal or regulatory requirements, but we will notify you as soon as possible.
The applicable law of this agreement is the law of the People's Republic of China. You and YHE agree that this agreement is signed in Binjiang District, Hangzhou City, Zhejiang Province , China . If a dispute arises between the two parties during the performance of the contract, they shall resolve it through negotiation; if the negotiation fails, both parties shall resolve it by means of litigation to the people's court with jurisdiction in the place where the agreement is signed.
The Service or third parties may provide links to other websites or resources. You understand and agree that we are not responsible for the availability of such external sites or resources and do not endorse or assume any responsibility for any content, advertising, products or other information on or available from such sites or resources . We shall not be liable for any damages or losses caused or alleged to be caused by or in connection with your use of or reliance on any content, goods or services available on or through such sites or resources.
Nothing in this Agreement shall be deemed to establish any partnership or agency relationship between you and YHE. Neither party shall be entitled to incur any liability, debt or cost, or to enter into any contract or other agreement, in the name of or on behalf of the other party.
YHE shall not be liable for any failure or delay in YHE's performance of its obligations under this Agreement or these Conditions of Service caused or caused by events beyond YHE's reasonable control.
The branches and subsidiaries of YHE Company are the third-party beneficiaries of this agreement, and they can enforce this agreement as parties to this agreement. YHE has the right to transfer, subcontract or replace YHE's rights and obligations under this agreement without derogating from your rights and interests.
If any provision of this Agreement is deemed invalid, void or unenforceable by a court of competent jurisdiction or any other competent authority, that provision shall be deemed deleted from this Agreement, but any other provision shall remain in force.
